I’m American and would like to incorporate a company here in Bangkok under the Treaty of Amity and ideally, I would like everything such as director and shareholder to be me and me only. Is that possible?
Panwa: Please note that if you are going to incorporate the company under the Treaty of Amity, the director can be you only. However, according to the Thai law, there must be at least 2 shareholders in the company, which can be you and a Thai or another American. Moreover, kindly note that the American shareholder must hold the majority of shares if the company has a shareholder with a different nationality.
